TERMS OF SERVICE

Account Terms

  1. You must be 18 years or older, or at least the age of majority in your jurisdiction, to use this Service.
  2. To access and use our services, you must register for a hosting.thewebfix.in account (“Account”) by providing your full legal name, current address, phone number, a valid email, and any other required details. We reserve the right to accept or reject your application at our sole discretion.
  3. You agree that the email address you provide will be the primary method of communication.
  4. You are responsible for keeping your password secure. We are not liable for any loss due to your failure to maintain password security.
  5. You are fully responsible for all activity and content (e.g., images, videos, text, files, code) associated with your account (“Materials”).
  6. Any breach of these terms or our Acceptable Use Policy (AUP) may result in immediate termination of your services.

Account Activation

  1. The person signing up will be the “Account Owner” and responsible for all activity on the account.
  2. If you're signing up on behalf of your employer, your employer will be the Account Owner. You must have the authority to bind them to these terms.
  3. Upon sign-up, we may create a PayPal Express Checkout or hosting.thewebfix.in Payments account on your behalf, depending on your location.
  4. You acknowledge that these payment gateways are third-party services. It's your responsibility to activate, manage, or deactivate them as needed.

General Terms

  • All pricing can be reviewed at hosting.thewebfix.in.
  • Accepted payment methods are listed on our website.
  • Invoices are generated 7 days prior to the due date. Failure to pay on time may lead to service suspension and eventual termination. A late fee applies after 5 days.
  • Subscription payments can be canceled anytime, but no refunds or credits will be issued after 7 days.
  • By registering, you agree to receive promotional emails from us and third parties. You can unsubscribe at any time using the link in the email.
  • Free migration is only available for same-panel transfers (e.g., cPanel to cPanel, Plesk to Plesk). We do not offer free migration between different panels (e.g., Plesk to cPanel).

Backups & Recovery

  • We offer automated backups as a complimentary service. No extra charges apply.
  • Backups are available only if they exist in our storage server at the time of request.
  • Accounts exceeding 15GB are not included in backups.
  • Users are fully responsible for maintaining their own data backups. We are not liable for data loss.
  • Backup rotation occurs weekly with a maximum of 4 backup copies retained.
  • After an account becomes overdue, we retain backup data for up to 28 days. After that, all data will be permanently deleted, and we are not responsible for recovery.

Adult Content Policy

We strictly prohibit adult content including pornography, nudity, or any sexually explicit material.

Zero Tolerance Spam Policy

  • We do not tolerate unsolicited emails, bulk messaging, or spam of any kind.
  • “Safe lists” and “double opt-ins” are also considered spam.
  • Violating users will have their accounts terminated immediately, with or without notice. No refunds will be issued.
  • Mailing limits: A maximum of 100 emails per cPanel account is allowed. Bulk mailing is strictly prohibited on shared servers.

Security & Malware

  • Using nulled or cracked themes/plugins is strictly forbidden.
  • If malware is found in your account, we reserve the right to terminate the account immediately without prior notice.
